Terms governing your use of HireFlow

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FoundryX ("Company," "we," "us," or "our"), governing your access to and use of the HireFlow platform. By creating an account, accessing, or using HireFlow in any way, you agree to be bound by these Terms in their entirety. If you do not agree, you must not use our platform.

1. About HireFlow

HireFlow is an AI-powered interview preparation platform operated by FoundryX, a company registered in Germany (Schmidener Str. 37, 71332 Waiblingen, Germany). Our platform provides adaptive AI-driven interview simulations, real-time voice-based practice sessions, comprehensive performance analytics, intelligent coaching feedback, and multi-language support across 74+ languages. HireFlow is designed to help job seekers prepare for interviews through realistic AI-powered practice — it is not an employment service, recruiting platform, or career placement agency.

2. Eligibility & Account Registration

To use HireFlow, you must meet the following eligibility requirements and agree to the following account responsibilities:

Age Requirement

You must be at least 16 years of age to create an account and use HireFlow. If you are between 16 and 18, you represent that you have obtained parental or guardian consent. By registering, you confirm that you meet this age requirement.

Accurate Information

You must provide truthful, accurate, and complete information during registration and keep your profile information current. Providing false or misleading information may result in immediate account termination.

Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must use a strong, unique password and must not share your account credentials with any third party. Notify us immediately at support@hireflow.pro if you suspect unauthorized access.

One Account Per Person

Each individual may maintain only one HireFlow account. Creating duplicate or multiple accounts — including to circumvent usage limits, exploit free tiers, abuse promotional offers, or evade a prior suspension — is strictly prohibited and grounds for termination of all associated accounts.

Account Transfers

Your account is personal to you and may not be transferred, sold, or assigned to another individual or entity without our prior written consent.

3. Services & Platform Features

HireFlow provides the following core services, subject to your subscription tier and available token balance:

AI Interview Practice

Adaptive, AI-generated interview questions that respond dynamically to your answers in real time. Sessions simulate realistic interview scenarios across behavioral, technical, and situational question types.

Voice-Based Interviews

Real-time voice interaction with AI interviewers featuring native-quality voice synthesis in 74+ languages. Voice recordings are processed for transcription and analysis.

Performance Analytics

Detailed post-interview reports with scoring across multiple competency dimensions, including communication, confidence, technical accuracy, and structured thinking.

Smart Coaching

Personalized coaching recommendations that target your specific weaknesses, track your progress over time, and suggest focused practice areas.

CV & Job Description Analysis

Upload your CV and target job descriptions to receive tailored interview questions that match the specific requirements of the roles you are pursuing.

We strive to maintain 99.9% platform availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party service outages, or force majeure events may temporarily affect availability. We will provide reasonable advance notice for planned maintenance when possible.

4. Acceptable Use Policy

You agree to use HireFlow responsibly and in compliance with all applicable laws and regulations. The following activities are strictly prohibited:

  • ✕Using the platform for any unlawful, fraudulent, or malicious purpose
  • ✕Attempting to reverse-engineer, decompile, disassemble, or extract source code from our AI models, algorithms, or proprietary systems
  • ✕Sharing, reselling, sublicensing, or redistributing your account access or any platform features to third parties
  • ✕Uploading, transmitting, or storing content that is harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
  • ✕Attempting to exploit security vulnerabilities, overload our systems through denial-of-service attacks, or circumvent rate limits or usage restrictions
  • ✕Using automated tools, bots, scrapers, or crawlers to access, extract data from, or interact with the platform without explicit written authorization
  • ✕Impersonating another person, misrepresenting your identity or affiliation, or creating accounts under false pretenses
  • ✕Interfering with other users' ability to use the platform or degrading the service experience for others
  • ✕Using HireFlow to develop competing products or services, or for benchmarking without written consent
  • ✕Circumventing or attempting to circumvent any technical measures we employ to enforce these Terms

Violation of this Acceptable Use Policy may result in immediate account suspension or permanent termination, at our sole discretion, without prior notice or refund. We reserve the right to report illegal activity to the appropriate law enforcement authorities.

5. Subscriptions, Payments & Billing

HireFlow offers both free and paid subscription tiers. By subscribing to a paid plan, you agree to the following terms:

Subscription Plans

Features, usage limits, and token allocations vary by subscription tier. Plan details, including pricing and included features, are displayed on our pricing page and may be updated from time to time. The specific features available to you are determined by your active subscription at the time of use.

Billing & Payment

All paid subscriptions are processed through Stripe, our PCI DSS-compliant payment processor. By subscribing, you authorize us to charge your selected payment method on a recurring basis (monthly or annually, depending on your chosen billing cycle). All prices are displayed in the applicable currency and are inclusive or exclusive of VAT/tax as indicated.

Token System

Certain premium features consume tokens from your allocated balance. Token allocations are tied to your subscription tier and billing cycle. Unused tokens do not roll over to subsequent billing periods unless explicitly stated in your plan terms. Token consumption rates are displayed before initiating each feature.

Plan Upgrades

You may upgrade your subscription at any time. Upgrades take effect immediately, and you will be charged a prorated amount for the remainder of your current billing cycle. Upgraded features and token allocations become available instantly.

Plan Downgrades

You may downgrade your subscription at any time. Downgrades take effect at the end of your current billing period. You will retain access to your current plan's features until the period concludes. Excess data or features beyond the lower tier's limits may be subject to archival or removal.

Cancellations

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period — you will retain access to paid features until then. No partial refunds are issued for unused time within a billing period.

Refund Policy

We offer a 30-day money-back guarantee for first-time paid subscribers. If you are not satisfied within the first 30 days of your initial paid subscription, you may request a full refund by contacting support@hireflow.pro. After the 30-day period, all payments are final and non-refundable, except where required by applicable consumer protection law.

Price Changes

We reserve the right to adjust pricing for our subscription plans. For existing subscribers, any price increase will be communicated at least 30 days in advance via email. If you do not agree with a price change, you may cancel your subscription before the new pricing takes effect.

Failed Payments

If a recurring payment fails, we will attempt to process the charge up to three additional times over a 10-day period. If all attempts fail, your account may be downgraded to the free tier. We will notify you of payment failures via email.

6. Content & Intellectual Property

Your Content

You retain full ownership of all content you upload to HireFlow, including CVs, resumes, cover letters, job descriptions, and your interview responses. By uploading content, you grant FoundryX a limited, non-exclusive, revocable license to process, store, and analyze this content solely for the purpose of delivering our services to you. This license terminates when you delete your content or your account.

Our Content & Platform

All HireFlow platform content — including but not limited to the user interface, design, AI models, algorithms, question databases, branding, logos, documentation, and marketing materials — is the exclusive intellectual property of FoundryX and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on our proprietary content without explicit written permission.

AI-Generated Content

Interview questions, feedback, performance reports, coaching recommendations, and other content generated by our AI system are provided for your personal, non-commercial use only. While we strive for high quality, AI-generated content may contain inaccuracies, biases, or errors. It should be treated as supplementary guidance and does not constitute professional career advice, employment counseling, or expert interview coaching.

User Feedback

If you voluntarily submit suggestions, feature requests, bug reports, or other feedback regarding HireFlow, you grant FoundryX an irrevocable, perpetual, worldwide license to use, modify, and incorporate such feedback into our platform without any obligation of compensation, attribution, or confidentiality.

DMCA & Takedowns

If you believe that content on HireFlow infringes your intellectual property rights, please contact us at support@hireflow.pro with details of the alleged infringement. We will investigate and respond in accordance with applicable intellectual property laws.

7. Disclaimers & Limitation of Liability

Please read this section carefully as it limits our liability to you.

As-Is Service

HireFlow is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

AI Limitations & Disclaimer

HireFlow's AI is a practice and preparation tool — not a substitute for professional interview coaching, career counseling, or employment advice. AI-generated responses, scores, and recommendations may contain inaccuracies, inconsistencies, or biases. You acknowledge that AI technology has inherent limitations and should not be relied upon as the sole basis for career decisions.

No Employment Guarantee

Using HireFlow does not guarantee interview success, job offers, or employment of any kind. Interview performance depends on numerous factors beyond our platform's control, including interviewer preferences, market conditions, and job-specific requirements.

Service Availability

While we strive for high availability, we do not guarantee uninterrupted, error-free, or secure access to our platform. Service may be interrupted for maintenance, updates, or due to circumstances beyond our control.

Limitation of Liability

To the maximum extent permitted by applicable law, FoundryX, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of HireFlow. Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount you paid to HireFlow in the twelve (12) months immediately preceding the event giving rise to the claim, or EUR 100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless FoundryX and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your violation of these Terms, your misuse of the platform, or your violation of any applicable law or third-party rights.

8. Termination & Account Deletion

Either party may terminate this agreement at any time, subject to the following terms:

Termination by You

You may delete your account at any time through your account settings page (Settings > Account > Delete Account). Upon deletion, your subscription will be cancelled, and your personal data will be permanently removed in accordance with our Privacy Policy.

Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if we determine in good faith that you have violated these Terms, engaged in fraudulent or abusive activity, or if required by law. We may also terminate inactive accounts (no login for 24+ consecutive months) after providing 30 days' notice.

Upon termination of your account, regardless of the reason:

  • All access to paid features and services ceases immediately
  • Your personal data will be deleted within 30 days (with the exception of data required to be retained by law)
  • Any outstanding payment obligations remain due and payable
  • Provisions of these Terms that by their nature should survive termination — including Sections 6 (IP), 7 (Disclaimers), 8 (Termination effects), 9 (Disputes), and any accrued obligations — shall survive
  • Unused tokens and remaining subscription time are forfeited and non-refundable (except within the 30-day guarantee period)

9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Jurisdiction

Any disputes arising from or relating to these Terms or your use of HireFlow shall be subject to the exclusive jurisdiction of the courts of Stuttgart, Germany, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at support@hireflow.pro to attempt to resolve the dispute informally. We will endeavor to respond within 14 business days. If we cannot reach a resolution within 60 days, either party may pursue formal legal remedies.

Class Action Waiver

To the extent permitted by applicable law, you agree to resolve any disputes with FoundryX on an individual basis and waive any right to participate in class action lawsuits, class-wide arbitration, or any consolidated proceedings relating to HireFlow.

EU Consumer Rights

If you are a consumer residing in the European Union, you are entitled to the protection of any mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights under applicable EU consumer protection legislation.

10. Modifications to These Terms

We reserve the right to update, modify, or replace these Terms at any time. For material changes — including changes to pricing, liability limitations, or user rights — we will provide at least 30 days' advance notice via email to your registered address and/or a prominent in-app notification. Non-material changes (such as formatting corrections, clarifications, or updates to contact information) may take effect immediately. Your continued use of HireFlow after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you disagree with any changes, you must stop using the platform and delete your account before the changes take effect.

11. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any applicable subscription terms, constitute the entire agreement between you and FoundryX regarding HireFlow and supersede all prior agreements, understandings, or representations.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by FoundryX to be effective.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. FoundryX may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets.

Force Majeure

FoundryX shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, pandemic, government actions, power outages, or internet infrastructure failures.
